What the prosecution must prove
The prosecution must prove that you resisted during your arrest.
Defences
There are a range of possible defences including, but not limited to, the following:
- there was an honest and reasonable mistake of fact;
- the arrest was completed.
Penalties
The maximum penalty for resisting arrest is $2,500 or imprisonment for 6 months.
