Amendments to the Evidence Act have recently commenced lifting the restrictions on reporting on sexual offences.

From 7 May 2020, persons charged with sexual offences can be named by the media from their first court appearance. This can occur so long as the naming of the accused does not in any way identify the alleged victim in the matter.

Previously, the media was prevented from publishing the name of an alleged sex offender before a guilty plea or court verdict, or prior to committal for trial in a higher Court. The historic reason for suppression was to protect the reputation of a person charged with sex offences who may later be found not guilty.

If you have been charged with a sexual offence and are yet to appear in Court, we recommend obtaining advice from a solicitor as soon as possible regarding whether your circumstances are likely to satisfy the Court when seeking a suppression Order under Section 69A of the Evidence Act.

Rudall and Rudall Lawyers have experience in representing clients who have been charged with various sexual offences and understand the concerns for those likely to be named as a consequence of these changes.
