Can SAPOL record me if I am arrested?

Yes. The process of arresting a person nearly always involves recording a person.

Once a person has been arrested it is protocol to arrange a “Record of Interview”. This is essentially where Police officers question the arrested person and record the process.

If you are arrested, you should not consent to an interview but rather exercise your right to speak with a lawyer. A person is only required to provide identifying information including their name and address. There is not an obligation to answer incriminating questions and it is advisable not to do so.

You do not have to make or sign a statement. You do not have to respond to someone else’s statement if it is shown to you. Again, it is usually best not to sign anything until you have seen a lawyer.
