I am receiving frequent requests to assist clients with responding to their land tax issues at the moment.

Last year, with much publicity the South Australian Government changed the Land Tax Regime.

People with multiple land ownings are most likely to be effected.

Essentially land held within a family trust is now taxed at a higher rate unless the trust is able to, and does, nominate an eligible beneficiary.

Land holdings within companies are now also grouped together to pay higher rates of tax than under the previous regime.

The state revenue office, (RevenueSA) requires all potentially affected land owners to log onto their website and update details, particularly for land held within a trust or company.  This process is tedious and requires access to electronic copies of trust documents, tax returns and similar documents. The tedious nature of the process is not helped by the fact that the website is having frequent difficulties coping with the traffic to the site.

We can help explain what you need to do, the effect of the changes, and the effect of nominating a beneficiary of a trust.  We can also assist you with the process of notifying Revenue SA of your land holdings.
