Do I have to attend the Divorce Hearing?

This depends on the circumstances of your marriage, specifically if there are children of the marriage and whether they are under 18 years of age.

If there aren’t any children of the marriage under 18 years, you are not required to attend the Divorce Hearing.

If it is a joint Application for Divorce with children under the age of 18 years, neither party is required to attend the hearing.

If it is a sole Application for Divorce with children under 18, the Applicant is required to attend. If the Respondent does not file a Response to the Application for Divorce, then the Respondent is not required to attend. If the Respondent files a Response to the Application for Divorce, then their presence is required at the Divorce Hearing.
